The decree 202/2017 “Conflict of interest”, sanctioned by the march 22, 2017, requires each provider interested in be submitted in a tender public procurement to submit an affidavit of interest at the time of registration.

Article 1 of the same mentioned the following situations than you must clarify the supplier if it is reached by one of them:

  1. Relationship by consanguinity within the fourth grade, and second of affinity
  2. Society or community
  3. Pending litigation
  4. Be a debtor or a creditor
  5. Having received benefits of importance
  6. Public friendship that manifests itself by a great familiarity and frequency in the treatment


These links make reference to the following officers: President, Vice president, Head of Cabinet and other Ministers and officials of equal rank, in the National Executive, although these do not have competence to decide on the contract or act that it is.

Furthermore, in the case of some of the items listed above to reach out to a provider (natural or legal person), it will be the Office's anti-Corruption who evaluates the case. This decree is protected by the Law of Ethics in the Exercise of the Public Function N° 25.188.
